“NCOT BIG BANK THEORY TUNE IN GIVEAWAY”
OFFICIAL CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN
(1)ELIGIBILITY:
KTVU Fox 2’s NCOT Big Bank Theory Tune In Giveaway (the “Contest”) is open only to legal residents of California, 21 years of age or older at the time of entry. Contest entrants (“Entrants”) must be located in one of the following counties: Alameda; Contra Costa; Lake; Marin; Mendocino; Napa; San Francisco; San Mateo; Santa Clara; Solano; or Sonoma. Employees of KTVU Fox 2, KICU-TV36, Cox Media Group, Inc., Second Street Media, Inc., NCOT and Eldorado Hotel Casino (the “Sponsors”), their affiliates, subsidiaries, franchisees, representatives, advertising agencies and their immediate family members are ineligible to participate in the Contest. Winners of any KTVU-sponsored promotion, contest or sweepstakes within the previous twelve (12) months are ineligible to participate in the Contest. Entrant must have no medical conditions that prevent Entrant from flying. Entrants must meet eligibility requirements at all times during the Contest period including the time for redeeming the prize. This Contest is void where prohibited by law.
(2)HOW TO ENTER AND PLAY:
(a)KTVU’s will broadcast, “The Big Bang Theory,” weekdays on KTVU starting at approximately 7:00 p.m. P.D.T. between Monday, June 10, 2013 and Friday, June 28, 2012. Sometime during KTVU’s broadcast of “The Big Bang Theory” between Monday, June 10, 2013 and Friday, June 28, 2013, a secret word (“Secret Word”) will be revealed, and viewers will be invited to visit KTVU’s website at www.ktvu.com to enter the Contest. The secret word will be one of the following: Nevada, EldoradoReno, EldoradoGetaway, NevadaNightlife or NevadaRelaxation.
(b)On the website, each participant (“Entrant”) must complete and submit an online entry form (the “Entry”), including his/her first and last names, age, complete address (including street address, city and ZIP code), telephone number where he/she can be reached, e-mail address, and the complete and correctly-spelled Secret Word. Entrants may begin submitting entries starting immediately after the Secret Word is revealed on one of the weekday broadcasts between the June 10, 2013 and June 28, 2013 of “The Big Bang Theory.” To be eligible for the Contest, Entries must be received no later than 11:59 p.m. P.D.T. on Sunday, June 30, 2013. Each Entrant must have an Internet or online service provider account in good standing with either free Internet access or a flat-monthly fee structure as of the date they submit any Entry. Each Entry must be made by an individual from a single computer and may not be made by proxy, automated device(s) or electronic means such as script, bot, macro or any other similar software or program. Each Entry will be deemed made by the registered owner of the e-mail address from which the Entry was received. All Entries are the property of KTVU and will not be returned. Only one Entry per e-mail address will be accepted between Monday, June 10, 2013 and Sunday, June 30, 2013 when a Secret Word is announced.
(c)On or about Monday, July 1, 2013, KTVU will conduct random drawings from all correct and eligible Entries received during the Contest Period to select one (1) Winner for the Contest (the “Winner”). Within two (2) weeks of Monday, July 1, 2013, KTVU will send a Release, Indemnity and Publicity Consent form as well as the General Affidavit of Eligibility form to the Winner. Once those forms have been signed, notarized and returned, KTVU will issue the prize to the Winner. If any Winner does not respond to KTVU’s notification within 72 hours of notification, KTVU, in its sole discretion, may disqualify the Winner and may or may not select as an alternate Winner by conducting a random drawing from remaining eligible Entries.
(3)PRIZE:
The Winner will receive the following Prize Package: a two (2) stay for two (2) at the Eldorado Hotel Casino, 345 North Virginia Street, Reno, NV, dinner for two at The Buffet and show tickets for two (2). The total approximate retail value of the Prize Package is $300.00.
No substitutions are allowed, except that the Sponsors may, in their sole discretion, substitute a prize of equal or greater value. Each Winner may waive his/her right to receive the Prize; however, the Prize is nonassignable, nontransferable, and not redeemable for cash. All fees and reporting requirements associated with federal, state and local taxes are the sole responsibility of each Winner. KTVU will send a publicity release, indemnification and affidavit of eligibility to each Winner; by accepting notification of any Prize award, each Winner agrees to complete, sign and return these documents no later than ten (10) days after receipt of the above-mentioned documents. Failure to sign and return the release, indemnification and affidavit may, at the sole discretion of KTVU, result in the Winner’s disqualification and the award of the Prize to an alternate Winner.
(4)ODDS:
The odds of winning depend on the number of correct, eligible Entries received.
(5)PARTICIPATION:
Participation in this Contest constitutes an agreement by each Entrant to comply with all terms, provisions and conditions of these Official Rules. Entrants further agree to be bound by the terms relating to the use of KTVU’s website, including its Privacy Policy. Entrants also authorize the Sponsors to use their name, voice, likeness, biographical data and city of residence in programming or promotional material without further compensation, unless prohibited by law. The Sponsors reserve the right to disqualify Entrants found tampering with or otherwise abusing any aspect of this Contest as solely determined by the Sponsors.
(6)SPONSORS’ RESERVATION OF RIGHTS
If for any reason the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, delay or failure in broadcasting “The Big Bang Theory” or any other cause beyond the Sponsors’ Control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, KTVU reserves the right, in its sole discretion, to modify, cancel, suspend or terminate the Contest.
(7)DISCLAIMER AND RELEASE:
By entering into the Contest or accepting or using any prize award or benefits, each Entrant releases the Sponsors and each of their affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of the Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). The Sponsors disclaim any liability for: (1) any error, omission, interruption, deletion, defect, delay or failure in the transmission of Entries or the operation of the Contest; (2) any theft, destruction or unauthorized access to or alteration of Entries; (3) any problems or technical malfunctions of any computer hardware, software, networks, lines, online systems, providers or servers associated with or used for the Contest, whether originating from Entrants, Sponsors or others; (4) failure of any Entry to be received by the Entry Deadline on account of traffic congestion or technical problems on the Internet or at any website, or any combination thereof; (5) any incomplete, inaccurate, illegible, garbled, defective, misdirected or misrouted Entries; (6) any injury or damage to any computer related to or resulting from participation in or downloading any materials for this Contest; or (7) any disputes, claims, damages, fees, costs, injuries or damages associated with or involving the use of the Prize.
(8)CONSTRUCTION:
All questions, issues, claims and disputes concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any Entrant, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than California.
(9)SPONSORS:
The Contest is sponsored by KTVU Fox 2, KICU-TV36, Cox Media Group, Second Street Media, Inc., NCOT and Eldorado Hotel Casino. The Sponsors’ decisions regarding the selection of the Winners and all other aspects of the Contest shall be final and binding in all respects. The Sponsors will not be responsible for any typographical, printing or other inadvertent errors in these Official Contest Rules or any other materials or administration relating to the Contest.
