“BIG O’ TIRES PAC 12 CONTEST” OFFICIAL CONTEST RULES

NO PURCHASE NECESSARY TO ENTER OR TO WIN
(1)ELIGIBILITY:
The “Big O’ Tires Pac 12 Contest” (the “Contest”) is open only to legal residents of California, 18 years of age or older at the time of entry. Contest entrants (“Entrants”) must reside in one of the following counties: Alameda; Contra Costa; Lake; Marin; Mendocino; Napa; San Francisco; San Mateo; Santa Clara; Solano; or Sonoma. Employees of KTVU Fox 2, KICU TV36, Cox Media Group, Inc., Second Street Media, Inc., Big O’ Tires and Southwest Airlines (collectively, the “Sponsors”), their affiliates, parent companies, subsidiaries, franchisees, representatives, advertising agencies and their immediate family members are ineligible to participate in the Contest. Winners of any KTVU-sponsored promotion, contest or sweepstakes within the previous twelve (12) months are ineligible to participate in the Contest. Each Entrant must have an Internet or online service provider account in good standing with either free Internet access or a flat monthly fee structure as of September 30, 2012. Entrants must meet eligibility requirements at all times during the Contest period including the time for redeeming the prize. This Contest is void where prohibited by law.
(2)HOW TO ENTER AND PLAY:
(a)Entrants can participate in this Contest in two different ways: Entrants can participate in the Contest by texting “PAC-12” to #12345 between 6:00 a.m. PDT on Monday, October 1, 2012 and 11:59 p.m. PDT on Monday, November 26, 2012 (the “Contest Period”). Entrants submitting Entries via text message will receive a text confirming their entry in the Contest. The confirming text will also provide Entrants with an opportunity to sign-up to receive additional information from Big O’ Tires about their products and services. Any such sign-up is voluntary and not required for sweepstakes entry. An Entrant’s decision to sign-up for or decline additional Big O’ Tires information will not effect the Entrant’s chance of winning. By submitting an Entry via text, each Entrant expressly consents to receive the text confirming their Entry in the Contest via an Automatic Telephone Dialing System. Any Entrant who signs up to receive additional information from any Sponsor also specifically consents to receive any future information via text by use of an Automatic Telephone Dialing System.
Entrants will be solely responsible for any text messaging rates charged by their providers (see your local carrier/service provider for details). By participating in a contest in which text message based entry is permitted, entrants acknowledge that text messages are delivered through third-party service providers. The Sponsors do not guarantee, and will not be responsible for the delivery or timeliness of any text message entry. Sponsors will use the time the message is logged as having been received by KTVU as the time of entry, regardless of the time at which the Entrant attempted to send the Entry and regardless of any technical problems or other complications that may have delayed its transmission and receipt. Sponsors are not responsible for any message failures, transmission delays or any other factor affecting the availability or performance of the text messaging service. Sponsors may request proof of identity as the rightful owner of any phone number used to transmit any text message Entry. Only one text Entry per Entrant will be accepted.
(b)Entrants can also participate in the Contest by submitting an entry on KTVU’s website at www.ktvu.com between 6:00 a.m. PDT on Monday, October 1, 2012 and 11:59 p.m. PDT on Monday, November 26, 2012. On the website, each Entrant must complete and fill out an entry form (“Entry”), including his/her first and last names, date of birth, complete address (including street address, city and ZIP code), telephone number where he/she can be reached, and e-mail address. Entrant must also enter the secret word “PAC-12.”
(c)Each Entry submitted online must be made by an individual from a single computer and may not be made by proxy, automated device(s) or electronic means such as script, bot, macro or any other similar software or program. Each Entry will be deemed made by the registered owner of the e-mail address from which the Entry was received. Only one Entry per Entrant will be accepted.
(d)On or about Monday, November 26, 2012, KTVU will conduct a random drawing from all correct and eligible Entries received during the Contest Period to select one (1) Winner for the Contest (the “Winner”). Within two (2) weeks of Monday, November 26, 2012, KTVU will send a Release, Indemnity and Publicity Consent form as well as the General Affidavit of Eligibility form to the Winner. Once those forms have been signed, notarized and returned, KTVU will issue the prize to the Winner. If the Winner does not respond to KTVU’s notification within seventy-two (72) hours, KTVU, in its sole discretion, may disqualify that Winner and may or may not select an alternate Winner by conducting a random drawing from remaining eligible Entries.
(3)PRIZE:
The Winner will receive the following Prize Package: four (4) tickets to the PAC 12 Championship game and roundtrip airline tickets on Southwest Airlines to the city chosen to host the championship game. The Winner’s outbound flight must depart from Oakland International Airport, Mineta San Jose International Airport or San Francisco International Airport. Winner and guests are required to fly together. Tickets are completely transferable and can be used at any time as long as seats are available. There are no restrictions or blackout dates. Southwest Airlines tickets expire on December 1, 2013. Minors must be accompanied by an adult. The approximate retail value of the Prize Package is $1,500. All fees and reporting requirements associated with federal, state and local taxes are the sole responsibility of the Winner. Pursuant to federal law, KTVU will issue a 1099 Form to the recipient of the Prize Package. The Prize Winner may waive his/her right to receive any prize; however, the prize is nonassignable, nontransferable and not redeemable for cash. No substitutions are allowed, except that the Sponsors may, in their sole discretion, substitute a prize of equal or greater value. Lost or stolen tickets will not be replaced.
KTVU will send a publicity consent, indemnification and affidavit of eligibility to the Winner; by accepting the prize, the Winner agrees to complete, sign and return these documents no later than five (5) days after receipt of the documents. Failure to sign and return these forms may, at the sole discretion of KTVU, result in the Winner’s disqualification and the award of the Prize Package to an alternate winner.
(4)ODDS:
The odds of winning depend on the number of eligible Entries received.
(5)PARTICIPATION:
Participation in this Contest constitutes an agreement by each Entrant to comply with all terms, provisions and conditions of these Official Rules. Entrants further agree to be bound by the terms relating to the use of the Sponsors’ websites, including their Privacy Policies. Entrants also authorize the Sponsors to use their name, voice, likeness, biographical data and city of residence in programming or promotional material without further compensation, unless prohibited by law. The Sponsors reserve the right to disqualify Entrants found tampering with or otherwise abusing any aspect of this Contest as solely determined by the Sponsors. All Entries become the property of Sponsors, and Sponsors reserves the right to use any information submitted by Entrants.
(6)SPONSORS’ RESERVATION OF RIGHTS
If for any reason the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, delay or failure in running the Contest, or any other cause beyond the Sponsors’ control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, KTVU reserves the right, in its sole discretion, to modify, cancel, suspend or terminate the Contest.
(7)DISCLAIMER AND RELEASE:
By entering into the Contest or accepting or using any prize, award or benefit, each Entrant releases the Sponsors and each of their affiliated companies, directors, officers, employees, parent companies, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). The Sponsors disclaim any liability for: (1) any error, omission, interruption, deletion, defect, delay or failure in the transmission of Entry forms or the operation of the Contest; (2) any theft, destruction or unauthorized access to or alteration of Entry forms; (3) any problems or technical malfunctions of any computer hardware, software, networks, lines, online systems, providers or servers associated with or used for the Contest, whether originating from Entrants, Sponsors or others; (4) failure of any Entry form to be received by the Entry deadline on account of traffic congestion or technical problems on the Internet or at any website, or any combination thereof; (5) any incomplete, inaccurate, illegible, garbled, defective, misdirected or misrouted Entry forms; (6) any injury or damage to any computer related to or resulting from participation in or downloading any materials for this Contest; (7) any disputes, claims, damages, fees, costs, injuries or damages associated with or involving the use of any prize; or (8) any delay, postponement, suspension or termination of the Contest.
(8)CONSTRUCTION:
All questions, issues, claims and disputes concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any Entrant, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than California, and shall be brought in state or federal court in California.
(9)SPONSORS:
The Contest is sponsored by KTVU Fox 2, KICU TV36, Cox Media Group, Inc., Second Street Media, Inc., Big O’ Tires and Southwest Airlines. The Sponsors’ decisions regarding the selection of the Winners and all other aspects of the Contest shall be final and binding in all respects. The Sponsors will not be responsible for any typographical, printing or other inadvertent errors in these Official Contest Rules or any other materials or administration relating to the Contest.
