MUST BE LEGAL U.S. RESIDENT OF A BAY AREA COUNTY LISTED BELOW AT LEAST 18 YEARS OR OLDER
(1)ELIGIBILITY:
KTVU Fox 2’s Watch, Win and Let Southwest Airlines Take You Places Giveaway (the “Contest”) is open only to legal residents of California with a valid driver’s license, 18 years of age or older at the time of entry. Contest entrants (“Entrants”) must reside in one of the following counties: Alameda; Contra Costa; Lake; Marin; Mendocino; Napa; San Francisco; San Mateo; Santa Clara; Solano; or Sonoma. Employees of KTVU Fox 2, KICU-TV36, Cox Media Group, and Southwest Airlines Co. (the “Sponsors”), their affiliates, subsidiaries, franchisees, representatives, advertising agencies and their immediate family members are ineligible to participate in the Contest. Winners of any KTVU-sponsored promotion, contest or sweepstakes within the previous twelve (12) months are ineligible to participate in the Contest. Each Entrant must have an Internet or online service provider account in good standing with either free Internet access or a flat monthly fee structure as of January 28, 2012. Entrants must meet eligibility requirements at all times during the Contest period including the time for redeeming the prize. This Contest is void where prohibited by law.
(2)HOW TO ENTER AND PLAY:
(a)KTVU’s broadcast of the “Southwest Airlines Chinese New Year Parade” will air on KTVU between 6:00-8:00 p.m. PST on Saturday, February 11, 2012, at which time the Contest will begin (“Start Date”). The Parade will be rebroadcast on KICU between 9:00-11:00 p.m. PST on Saturday, February 11, 2011 and again between 3:00-5:00 p.m. PST on Sunday, February 12, 2011 on KTVU Fox 2. Sometime during KTVU’s broadcast and KICU’s rebroadcasts of the “Southwest Airlines Chinese New Year Parade” a secret word (“Secret Word”) will be revealed, and viewers will be invited to visit KTVU’s website at www.ktvu.com to enter the Contest.
(b)On the website, each participant (“Entrant”) must complete and submit an online entry form (the “Entry”), including his/her first and last names, age, complete address (including street address, city and ZIP code), telephone number where he/she can be reached, e-mail address, and the complete and correctly-spelled Secret Word. To be eligible for the Contest, Entries must be received no later than 11:59 p.m. PST on Sunday, February 12, 2012. Each Entrant must have an Internet or online service provider account in good standing with either free Internet access or a flat-monthly fee structure as of the date they submit any Entry. Each Entry must be made by an individual from a single computer and may not be made by proxy, automated device(s) or electronic means such as script, bot, macro or any other similar software or program. Each Entry will be deemed made by the registered owner of the e-mail address from which the Entry was received. All Entries are the property of KTVU and will not be returned. Only one Entry per email address will be accepted.
(c)On or about Tuesday, February 14, 2012, KTVU will conduct a random drawing from all correct and eligible Entries to select one Winner of the Contest (the “Winner”). Within 2 weeks of entering, KTVU will notify the Winner by telephone and/or e-mail. KTVU will make no more than two (2) attempts to notify the Winner. If any Winner does not respond to KTVU’s notification within seventy two (72) hours of notification, KTVU, in its sole discretion, may disqualify the Winner and select an alternate Winner by conducting a random drawing from remaining eligible Entries.
(3)PRIZE:
The Winner will receive the following Prize Package: Four (4) roundtrip airline tickets on Southwest Airlines regularly scheduled and published service to the Winner’s choice of any destination to which Southwest Airlines currently flies, as set forth in Addendum A at the bottom of these Official Rules. Tickets are subject to Southwest’s terms and conditions; certain restrictions may apply. The Winner’s outbound flight must depart from Oakland International Airport, Mineta San Jose International Airport or San Francisco International Airport. Winner and guests are not required to fly together. Tickets can be used at any time prior to expiration, as long as seats are available. Southwest Airlines tickets are valid for one (1) year from date of issuance. Minors must be accompanied by an adult. The total approximate retail value of the Prize Package is $1,600.00.
No substitutions, cash equivalents, or transfers of prize are allowed, except that the Sponsors may, in their sole discretion, substitute a prize of equal or greater value. The Winner may waive his/her right to receive the Prize. The Prize is not redeemable for cash and may not be sold to another party. All fees and reporting requirements associated with federal, state and local taxes are the sole responsibility of the Winner. KTVU will send a publicity release, indemnification and affidavit of eligibility to Winner; by accepting notification of any Prize award, Winner agrees to complete, sign and return these documents no later than ten (10) days after receipt of the above-mentioned documents. Failure to sign and return the release, indemnification and affidavit may, at the sole discretion of KTVU, result in the Winner’s disqualification and the award of the Prize to an alternate Winner. The Winner’s guests, or if minor(s), their parent(s)/legal guardian(s), must execute Liability Releases, and where legal, Publicity Releases, prior to the issuance of tickets.
(4)ODDS:
The odds of winning depend on the number of correct, eligible Entries received.
(5)PARTICIPATION:
Participation in this Contest constitutes an agreement by each Entrant to comply with all terms, provisions and conditions of these Official Rules. Entrants further agree to be bound by the terms relating to the use of KTVU’s website, including its Privacy Policy. Entrants also authorize the Sponsors to use their name, voice, likeness, biographical data and city of residence in programming or promotional material without further compensation, unless prohibited by law. The Sponsors reserve the right to disqualify Entrants found tampering with or otherwise abusing any aspect of this Contest as solely determined by the Sponsors.
(6)SPONSORS’ RESERVATION OF RIGHTS
If for any reason the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, delay or failure in broadcasting the “Southwest Airlines Chinese New Year Parade” or any other cause beyond the Sponsors’ Control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, KTVU reserves the right, in its sole discretion, to modify, cancel, suspend or terminate the Contest.
(7)DISCLAIMER AND RELEASE:
By entering into the Contest or accepting or using any prize award or benefits, each Entrant releases the Sponsors and each of their affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of the Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). The Sponsors disclaim any liability for: (1) any error, omission, interruption, deletion, defect, delay or failure in the transmission of Entries or the operation of the Contest; (2) any theft, destruction or unauthorized access to or alteration of Entries; (3) any problems or technical malfunctions of any computer hardware, software, networks, lines, online systems, providers or servers associated with or used for the Contest, whether originating from Entrants, Sponsors or others; (4) failure of any Entry to be received by the Entry Deadline on account of traffic congestion or technical problems on the Internet or at any website, or any combination thereof; (5) any incomplete, inaccurate, illegible, garbled, defective, misdirected or misrouted Entries; (6) any injury or damage to any computer related to or resulting from participation in or downloading any materials for this Contest; or (7) any disputes, claims, damages, fees, costs, injuries or damages associated with or involving the use of the Prize.
(8)CONSTRUCTION:
All questions, issues, claims and disputes concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any Entrant, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than California.
(9)SPONSORS:
The Contest is sponsored by KTVU Fox 2, KICU-TV36, Cox Media Group and Southwest Airlines Co. The Sponsors’ decisions regarding the selection of the Winners and all other aspects of the Contest shall be final and binding in all respects. The Sponsors will not be responsible for any typographical, printing or other inadvertent errors in these Official Contest Rules or any other materials or administration relating to the Contest.
